Your signed acceptance of the GiteWise Site Design and Build proposal for your website implies your acceptance of and adherence to these terms and conditions and shall be deemed a purchase with payment due as defined.

Property Ownership

Your purchase of the GiteWise website design and build service grants you rights to use all provided materials and software for your own benefit or on behalf of a single client for the creation of a single website. You may not duplicate the GiteWise page layout library in whole or in part, nor create a derivation thereof, and offer this for resale in any form without prior consent. You may, however, backup up your site, including the GiteWise page layout library for your own security.

You may not clone, duplicate or make available for use by third parties any of the GiteWise package in whole or in part. Your purchase grants you a single site licence. This shall be defined as a single website on one domain.

If you wish to create a second website using the original supplied contents or a derivation thereof, please contact GiteWise. A special purchase price may be negotiable.

Theme Licence

Your development website shall include a customised premium theme supported by a valid developer’s licence held by GiteWise. This licence grants GiteWise permission to use the theme as an integral part of its website products and services and in so doing confer equivalent personal licence-holders’ benefits to GiteWise clients in accordance with these terms and conditions.

In effect, your purchase of the GiteWise website design and build service includes licensed usage of the integrated premium theme, together with access to software updates released by the theme provider during the initial 12-month period.

At the end of the first year, you will have the option of renewing your GiteWise hosting and client support and continuing to benefit from theme updates or opting out of GiteWise hosting and client support. In the event of your choosing not to continue with GiteWise hosting and client support, you shall become responsible for managing your future access to theme updates. Your site will continue to function without such updates, but for optimum performance, security and reliability, it is considered good practice to keep whichever WordPress theme you use up to date. You may therefore wish to purchase your own licence direct from the theme provider.

Alternatively, you could switch your site to a different theme altogether. As the theme GiteWise uses for the website design and build service uses a non-standard user interface, any switch to a different theme will benefit from specialist help to make sure things run smoothly. Website Hosting

Your GiteWise website is offered with 12 months cloud hosting for a single website. This is arranged through a leading hosting provider designated by GiteWise. The choice of hosting provider is entirely at GiteWise’s discretion and although expected to remain constant is subject to review without notice should GiteWise consider it in the best interests of maintaining or improving the level of service.

The 12-month period shall begin one calendar month after the date of receipt of your signed acceptance of the GiteWise Website Design and Build Proposal. So you effectively have one month’s free hosting of your development site in addition to 12 months hosting (and software updates) on your own domain.

If your site is not ready to go live on your own domain at the end of this free hosting period, work will continue on your site on the temporary domain provided by GiteWise. Nonetheless, your 12 month-hosting period will begin on the due date and expire 12 months later, which shall be 13 months from the date of purchase.


A part payment of £150 is due within 28 days of purchase. GiteWise will invoice you for this. The balance is due on completion or after 60 days if work is still ongoing.

Preferred method of payment is by online bank transfer. If you wish, you can pay by PayPal or by cheque. You will find the account details and address on the invoice. Once full payment is received, your site will be made publicly accessible on the internet at your chosen URL.

Refund Policy

GiteWise offers its services with a guarantee of satisfaction. This shall be interpreted by GiteWise as your being completely happy with the product and service you receive. Should you have any justifiable cause for complaint or if your expectation of the product and service from the given description does not meet with your satisfaction, you shall be required to put this in writing using the form on the contact page. GiteWise will then review your complaint and respond within seven days. In any event, any complaint of this nature must be submitted within 30 days of purchase.

Copyright Infringement and DMCA Policy

GiteWise asks others to respect its intellectual property rights as it respects the intellectual property rights of others. If you believe that material located on or linked to by this website violates your copyright, you are encouraged to notify GiteWise in accordance with GiteWise’s Digital Millennium Copyright Act (“DMCA”) Policy. GiteWise will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. GiteWise will terminate a visitor’s access to and use of the website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of GiteWise or others. In the case of such termination, GiteWise will have no obligation to provide a refund of any amounts previously paid to GiteWise.

Intellectual Property

This agreement does not transfer from GiteWise to you any GiteWise or third-party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with GiteWise. GiteWise, this website, the GiteWise logo, and all other trademarks, service marks, graphics and logos used in connection with this website are trademarks or registered trademarks of GiteWise or GiteWise’s licensors. Other trademarks, service marks, graphics and logos used in connection with the website may be the trademarks of other third parties. Your use of the website grants you no right or license to reproduce or otherwise use any GiteWise or third-party trademarks.

Personal Terminology

In this document as well as in our privacy policy, the following terminology applies: “customer”, “client”, “you” and “yours” refer to you, the person accessing our website and accepting the terms. “I” “We” and “us” refers to Martin Brackstone, the owner of the GiteWise brand and its products, or to any authorised appointed agent. “Us” may also refer to both the customer and GiteWise.

These terms and conditions are subject to change without notice. However, you will receive notification by email of any amendments over and above minor editing for clarity.
